I love the idea of a watchdog organization but and i say lets push for this revolution. Sadly, I think the general public will fail in protecting themselves from this threat by taking any sort of action such as going to an independent site. This is the same general public that doesn't even know that our Bill of Rights has been taken away from us. I am however all for a motion to protect internet users from the ramifications that could occur from simply clicking and agreeing (while not understanding) a T.O.S. Right now the problem is pretty much every site we go to has these hidden rules and all it does is protect them legally and binds us to basically a contract thats only benefit is using a popular site or application. The problem i really see with Terms of Service is that even though people are rarely prosecuted on them now we should not let them have the opprotunity to do it in the future. We have to get out of this "It can never happen to me" mentality because it is gonna fuck us in the ass if we don't stand up for ourselves. Like I said we cant trust a T.O.S to protect us we have to know what we are signing away and if it is worth possible jail time or whatever. Now I'm just ranting like you did in your video...PEACE
I have the same problem (well.. "had", I don't go out and buy physical software so much anymore) with accepting the T.O.S. on a product I would buy at the big blue box before I could use it. But you don't get to see the T.O.S. until you open it. And if, for any number of reasons, you don't like something you managed to take from reading their T.O.S. upon your attempt to install, don't even think you'll be able to return it to the retailer from which it came OPENED and get anything other than another copy of the software.
T.O.S.'s are bunk in their current form. Products should have consice T.O.S. "Nutritional Labels" (so to speak), and the nets could benefit from just a tad more accountability on everyone's part to make sure T.O.S. are easy to understand and that ignorance of the rules isn't an excuse to not abide by them.
This story really bends the law as far as I am concerned. To get the lady on "something" is all they really wanted since they couldn't get her on being a HUGE DOUCHE BAG! The only problem I see with this conviction is that the rest of us are going to suffer now. Once a law or conviction has been passed the doors are open for all sorts of new ways for people to sue each other over basically nothing. Once the first person sued McDonalds for how hot their coffee was, it was flood gates open and everyone had a beef with the clown in large red shoes.
Would a service online giving out service agreement advice be a good idea? Hell yeah it would. I never read those either. I just click forward and get this job done. If you sat there online and read all that crap I would still be using iTunes 5. As a consumer we would spend most of our time reading that shit instead of enjoying the programs.
I think something like this could be detrimental to the software or website companies if people are afraid to agree to terms of service. I know that if I find out I am in trouble of being sued for miscalculating my age on some website I am NOT GOING TO SIGN UP. I think others would think the same way. This is a bad sign for websites and their terms of service. A sad day indeed when you learn of another way in which you can be sued for no apparent reason.
I'm sure that maybe some people have ATTEMPTED to read the entire TOS at one point in their lives but sadly after the first paragraph they stop and scroll down to the "I Agree" button. But I think that people don't take the Terms of Service seriously because they don't see a real threat by agreeing to a site. I think that more should be done in order to let people know exactly what they are doing, but how can that happen? I don't see a way for people to make users of a site read something about the terms, the reason people skip the terms in the first place is the amount of reading in the Terms of Service. But at the same time I'm sure that some sites purposely rely on people not examining the Terms of Service because some of their violations would turn people away, or that they will be able to catch someone in a bind if need be at some point during the users stay.
Even though what that mother did was terrible, I don't think she should be charged with anything other than TOS violation. Sure, she should definitely burn in hell for being that coldhearted, but I don't think that she should be prosecuted (unless she threatened the girl). It is sad though; being a teenager myself (15), I know that a lot of kids around my age are really unstable, and it's a shame that a woman would do such a thing.

Just a follow-up, I believe she shouldn't be charged/prosecuted for coersion/whatever because you don't know what any individual person's reaction will be - one person might kill themselves, another might be like, "whatever, dude." It's tragic, because everybody reacts differently.

I really wish something like this was out there, because people, including me, don't ever take the time to read through the lengthy legal documentation. We don't know what's inside it, we just figure that they aren't going to screw us. In reality, most places would probably screw us if given the chance. If I am signing up for a website and it's services, I want to know that my personal information is protected and will not be sold to third party companies or anything else that they would do with it. As a result of things like this, there's a possibility that you would receive a virus, say, from a spam email. From what I hear, this is pretty damn common. I know I would be pissed if my computer got fucked up because a dickish website fucked me over.
Also, I realize that is relation to the post of this video, I am way behind, but this is the first time I've been on your blog. Nice blog by the way.
